TERMS AND CONDITIONS FOR JANE ATTER PHOTOGRAPHY
WHAT IS PHOTO SESSION FEE
Photo Session fee is a non-refundable retainer that is earned by the Photographer to perform the services specified herein. Photo session Fee includes time, talent of the photographer, including time for breaks for the baby, adjusting session time based on nap time, editing time, full use of the studio equipment (including free rental of any Studio dresses for mums, babies, children) and all the props, consultation and advice before the session and viewing session after the photo session.
WHAT HAPPENS WHEN CLIENT DOESNT SHOW UP OR LATE?
Upon payment, the Photographer will reserve the time and date agreed upon by both parties. The Client agrees that this retainer is earned by the Photographer when paid, and is remitted in consideration of the experience, reputation, skill of the Photographer, and in consideration of the inability of the Photographer to schedule other clients during this time. This session fee is a non-refundable retainer, should the Client cancel the session, doesn’t turn up on the day without the prior notice, or is late for longer than 30 minutes without notice. It is transferable to another date, provided that notice of 3 days is given to the Photographer.
MATERNITY PHOTO SESSION FEE
When booking a Maternity Photo session — maternity photography session fee (£100) includes all the dress and outfits and also Newborn photo session fee (£100) comes complementary. Client also receives a Triplex (leather folder with 3 Art prints with newborn and maternity images) only after a payment is made for one of the newborn packages.
CAKE SMASH SESSION FEE
When booking a Cake Smash photo session, session fee includes above all of the mentioned earlier also a cake for the photo session OR canvas and paints for paint smash photo session. Vegan Cake is available at £20 due to more complicated baking method.
IN HOME PHOTO SESSION — TRAVEL FEE + PARKING CHARGES
In home photo session comes with £150 travel fee. Photo session and Travel fee includes all the extra time of travelling, packing, unpacking, setting up, congestion charges, petrol. Parking is not included in the travel Fee charges. When the photo session is done in Client’s home additional parking charges may apply.
DIGITAL PRODUCTS ARE SOLD SEPARATELY
Digital photos and printing products are sold separately. Client agrees to consult with the Price list before booking the photo session.
Grow with Me package requires additional payment for the Cake or Drawing materials at the time of the Cake Smash Photo session.
PAYMENT DETAILS:
Photo session fee is to be paid at the time of booking by way of direct Bank transfer or via a booking system. Half of the chosen package (but no less than £250) is to be paid on the day of the photo session, second half is to be paid before photos are ready. Packages are to be paid for via direct Bank transfer.
COOPERATION:
The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose for photographs at the Photographer’s direction; pre-shoot consultations; etc. Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation.
Photographer is not responsible for lack of smiles, for photos or poses Client wanted but forgot to ask about, Photographer is going to take photos of men in the clothes they have provided, no reshoot in the different clothes will be provided. It is responsibility of the Client to come to the photo session with clean hair, tidy nails and make sure client brings clothes for the men (husband, dad etc).
Client agrees to learn Photographer’s style and colour scheme ahead of the photo session and also shall speak up should the Client wish to make any changes during the photo session — subsequent editing of something that doesn’t exist will not be performed by the Photographer.
COPYRIGHT:
The photographs produced by Jane Atter Photography are protected by the UK Copyright Law and may not be reproduced in any manner without Jane Atter Photography’s explicitly written permission. The photographer retains copyright to the photographs, and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for which the client pays, for personal use only. A print release will be provided to the Client, with which the Client may make prints for personal use and sharing, as well as use for their personal blogs and social networks. Photographs shall be delivered to the Client via digital download. The Client is also prohibited from using photos in contests or commercial use (advertising) without written consent from Jane Atter Photography. Client may not, for any reason, sell their images to any third party.
IMAGE DELIVERY:
Digital files can be purchased separately. Price list is available on the website.
Digital images will be delivered within 6 weeks after the session date (provided half of the selected package is paid for) in full-resolution JPEG files, via a private online gallery opened for 1 month. Any un-purchased files get deleted. Raw (CR2) images are not sold or given away. they get destroyed after photos are delivered to the Clients.
Sneak Peek shall be available on the Photographer’s private FB message or via a private Instagram message in 7 days after the session date provided package has been paid for in full or in half. The rest of the photographs shall be available within 6 weeks from the session date.
The files come with a print release, and are recommended to be printed through Jane Atter Photography’s chosen lab via the Client’s gallery. Photos, albums and wall art purchased through Jane Atter Photography are 100% guaranteed for accuracy and quality. If the Client chooses to print through any labs other than through the photographer, Jane Atter Photography holds no responsibility for the quality of the photographs produced.
POSTAGE:
Chosen Products (Wall Art, Albums, prints) shall be sent by currier — additional flat postage fee of £16.50 applies. Postage is included in all inclusive packages.
Only one postage fee is included in the all inclusive package price.
WHEN PHOTOS GET DELIVERED vs PAYMENT:
Photos (digital or printing products) shall be delivered once the contract is reconciled and payment is made in full.

Photographs shall be delivered to the Client via digital download. The Client is prohibited from further editing of images in any form. The Client is also prohibited from using photos in contests without written consent from Jane Atter Photography. Client may not, for any reason, sell their images to any third party.
In lieu of Data Protection Act 2018, sch2, p2., the Client & Subject hereby grant to Jane Atter Photography the irrevocable right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and other purpose ; to alter the same; and to copyright the same. The Client hereby releases Jane Atter Photography from all claims and liability relating to said photographs. Photos are published (if published) anonymously (unless otherwise agreed with the Client) Parents are allowed to request consultation on specific photos shared.
Fully private photo sessions are available. Purchase of the copyright is additional fee of £100.
LIMIT OF LIABILITY:
In the unlikely event that the Photographer is injured or becomes too ill, or has an extreme emergency that prevents him or her from photographing the event, the Photographer will make every effort to reschedule the event. If for whatever reason this is not possible, responsibility and liability is limited to the return of all payments received for the package or session purchased.
PHOTO SHOOTING TIME:
Photo session takes up to 3-4 hours. The Client agrees that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting time commences at the scheduled start time. Any Client that is late arriving to the photography session will have the amount of time late deducted from the time allotted for the session. Clients shall not be compensated for the time deducted from the event due to late arrival of the Client. When client is more than 30 minutes late without any prior notice,, the session may be considered cancelled, a new session fee shall be required to book a new date for a photo session.
LOCATION and PARKING PERMITS & FEES:
Photo session will take place at Jane Atter Photography Studio in Wimbledon. Full address is 3 Kingswood Road, SW19 3ND.
Should the Client arrive by car, an appropriate parking permit will be issued free of charge.
RESCHEDULING:
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 48 hours prior to their shoot without penalty. Should client fail to give 48 hours notice, or decide to completely cancel the shoot, the non-refundable retainer is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
In case for any COVID related restrictions the newborn session becomes impossible to perform or baby gets born earlier, the whole amount paid shall be transferred towards the 3 month old photo session, sitter session or any other photo session for the baby (sitter session at 6-7 months or first birthday session which ever will be the nearest to the time permitted to open the studio for business).
PREPARATION:
A Full information pack on how to prepare to the photo session will be sent once the booking process is complete. Booking is complete with the signature of this contract and payment of the retainer fee.
The Client shall feed the baby a full feeding right before the session. Baby shall be fed immediately at the beginning of the session. The baby must be dressed in loose fitting clothing for ease of changes for portraits. The Client shall bring at least two bottles for feeding or supplies for nursing. If a pacifier or soother is required, the Client shall supply those items.
Shoes worn at the photo session have to be new out of a box or have a paper tape on the soles to prevent shoe marks on the backdrops. For the failure of complying with this requirement and or any marking left on the backdrop a £100 penalty fee to replace the backdrop will apply.
SUBJECTS:
The Client shall maintain control of other subjects including siblings. It is the responsibility of the Client to ensure the cooperation of additional subjects as not to intrude on the baby’s immediate area. The Client shall provide all necessary controls over additional subjects. Should Client’s other subjects aka children break or damage any items (equipment, props, backdrops etc) in the studio Client agrees to compensate for the replacement items.
IMAGE STORAGE:
Digital photos and raw files are stored for the reasonable time, not exceeding 4 months. All photo selections, alterations, changes, amendments should be done and requested within that time frame. After the storage time expires, the photographer has rights to delete the images. Storage can be extended on request, provided the Photographer is notified about this in advance. Additional storage is charged at £50/month.
PHOTO STUDIO PROMISE:
In the unlikely event the Client doesn’t like any of the photos taken at the newborn photo session — the session fee shall be refunded, right after the photo session, before or during the viewing provided clients hasn’t received any tangible products such as digital files in any shape way or form (including but not limited to social media size copies, any preview online galleries, emailed files or any prints, wall art, albums, triplex or any other printed products, prior to the statement. Once any of the products been received, photos are considered accepted.
JURISDICTION:
The UK courts serving London, London shall have exclusive jurisdiction over disputes arising from this Agreement, and both parties hereto consent to the jurisdiction of such courts.
